Bankruptcy Warrant Release Conditions

Once a bankruptcy record is established in TINS, the Comptroller’s office will hold the warrants until one of the following conditions is met:

  • Authorization to release the warrants is received from the:
    • Office of the Attorney General Bankruptcy Division

      –OR–

    • A bankruptcy court or trustee
  • The warrants become void by statute of limitations
  • The payee provides documentation that the bankruptcy has been closed, thus making the warrant eligible for offset
  • The payee’s hold or the held warrant is released by the hold source agency

Debtors can be on hold by more than one hold source agency.

If debtor is… And the debt to your agency is paid… Then the held warrant(s)…
Only on hold by your agency,
  • Release the hold
  • Delete the BKRUPD record
Will be released to the paying agency for distribution to the payee.
On hold by another hold source agency,
  • Release the hold
  • Do NOT delete the BKRUPD record
Will continue to be held against the other state debt.
