Bankruptcy Warrant Release Conditions
Once a bankruptcy record is established in TINS, the Comptroller’s office will hold the warrants until one of the following conditions is met:
- Authorization to release the warrants is received from the:
- Office of the Attorney General Bankruptcy Division
–OR–
- A bankruptcy court or trustee
- Office of the Attorney General Bankruptcy Division
- The warrants become void by statute of limitations
- The payee provides documentation that the bankruptcy has been closed, thus making the warrant eligible for offset
- The payee’s hold or the held warrant is released by the hold source agency
Debtors can be on hold by more than one hold source agency.
