Voluntary Retirement Plan Contributions

An individual may be a member of the elected class of membership in the Employee Retirement System (ERS) if he or she:

  • Holds a state office that is normally filled by statewide election and that is not included in the coverage of the Judicial Retirement System of Texas Plan One or the Judicial Retirement System of Texas Plan Two.
  • Is a legislator.
    or
  • Is a district or criminal district attorney receiving salary from the general revenue fund.

An individual who elects to participate as a member of the elected class must complete and file a form with ERS.

A member of the elected class must contribute according to the following chart:

Retirement System Eligible Participants Percent of Monthly Compensation
Employees Retirement System (ERS) Groups 1, 2 and 3 Elected officials who were active or former members of ERS and who did not withdraw their account before Sept. 1, 2022 9.5
Employees Retirement System (ERS) Group 4 Elected officials who became members of ERS after Aug. 31, 2022 6.0

Other Considerations

The contributions must be made through payroll deduction, and the individual may terminate contributions at any time.
