Salary of Administrative Head of State Agency

A state agency (defined as a board, commission, department, institution, office or other agency in the executive branch of state government that is created by the constitution or a statute of this state, including an institution of higher education as defined by Texas Education Code, Section 61.003 or the Supreme Court of Texas, the Texas Court of Criminal Appeals, a court of appeals, or another agency in the judicial branch) may not pay its administrative head more than the rate established in an agency’s Schedule of Exempt Positions listed in the General Appropriations Act (GAA). This is applicable even in situations where the agency head is assigned to perform duties of a position listed in the state’s position classification plan. The administrative head of a state agency may only receive a higher salary if it is authorized in the GAA.
