Agency-Specific Provisions
Stand-By/On-Call Pay
Certain agencies are authorized to pay employees for the periods of time when the employee is not actually performing work but is required to remain at, near or able to return to a duty station when called upon. This is known as stand-by or on-call pay.
Texas Facilities Commission
The Texas Facilities Commission may pay compensation for on-call time at the following rates:
- Credit for one hour worked for each day on-call during the normal work week.
– and – - Credit for two hours worked for each day on-call during weekends and on holidays.
This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.
For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA only to the extent required by federal law.

Department of Family and Protective Services
The Department of Family and Protective Services may pay compensation for on-call time at the following rates:
- Credit for one hour of base pay worked for each day on-call during the normal work week.

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

Health and Human Services Commission
The Health and Human Services Commission may pay employees of mental health state hospitals and state-supported living centers compensation for on-call time at the following rates:
- Credit for one hour of base pay worked for each day on-call during the normal work week.
– and – - Credit for two hours of base pay worked for each day on-call during weekends and on holidays.
This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.
For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA only to the extent required by federal law.

Texas School for the Blind and Visually Impaired
The Texas School for the Blind and Visually Impaired may pay compensation for on-call time at the following rates:

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

Texas Department of Transportation
The Texas Department of Transportation may pay compensation for on-call time at the following rates:
- Credit for one hour worked for each day on-call during the normal work week.
– and – - Credit for two hours worked for each day on-call during weekends and on holidays.
This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.
For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA and employees will receive FLSA overtime rates for the on-call duty.
