Stand-By/On-Call Pay
HHSC, TSBVI, TCEQ and TxDOT

Health and Human Services Commission (HHSC)

HHSC may pay employees of mental health state hospitals, state-supported living centers, and personnel in the Regulatory Services Division compensation for on-call time at the following rates:

  • Credit for one hour of base pay worked for each day on call during the normal work week.
    and
  • Credit for two hours of base pay worked for each day on call during weekends and on holidays.

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

For Fair Labor Standards Act (FLSA) nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA only to the extent required by federal law.

Texas School for the Blind and Visually Impaired (TSBVI)

TSBVI may pay compensation for on-call time at the following rates:

  • Credit for one hour worked for each day on call during the normal work week.
    and
  • Credit for two hours worked for each day on call during weekends and on holidays.

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA only to the extent required by federal law.

Texas Commission on Environmental Quality (TCEQ)

TCEQ may pay compensation for on-call time for staff with emergency response duties at the following rates:

  • Credit for one hour worked for each day on call during the normal work week.
    – and –
  • Credit for two hours worked for each day on call during weekends and on holidays.

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA only to the extent required by federal law.

Texas Department of Transportation (TxDOT)

TxDOT may pay compensation for on-call time at the following rates:

  • Credit for one hour worked for each day on call during the normal work week.
    and
  • Credit for two hours worked for each day on call during weekends and on holidays.

This credit is in addition to actual hours worked during normal duty hours or actual hours worked during on-call status.

For FLSA nonexempt employees, an hour of on-call service is considered an hour worked for the purposes of the FLSA and employees will receive FLSA overtime rates for the on-call duty.
