Salary Limited to Maximum Group Rate

Background

At the end of each legislative session, the State Auditor’s office in conjunction with the Legislative Budget Board publishes a classification salary schedule in the General Appropriations Act effective for that biennium that establishes the minimum and maximum salary rates for each pay group described in the position classification plan.

Policy

Any employee of the executive or judicial branch of state government whose position is subject to the state’s position classification plan may not be paid an annual salary that exceeds the maximum rate of the pay group to which the employee’s position is allocated.

ERS exemption

The Employees Retirement System of Texas (ERS) has special authority that exempts it from this provision to the extent the ERS board of trustees determines an exemption is necessary for the performance of fiduciary duties.

TRS exemption

The Teacher Retirement System of Texas (TRS) has special authority that exempts agency employees from this provision to the extent that the TRS board of trustees determines an exemption is necessary for the performance of fiduciary duties.
