Lesson 6: Bankruptcy Records
TINS Bankruptcy File (BKRUPD) Screen
BKRUPD is used to maintain bankruptcy information on a debtor who may have an active bankruptcy case.
Federal bankruptcy laws take precedence over state debts. If a debtor has an active bankruptcy case and becomes or is a payee, held warrants cannot be offset against the state debt without authorization from the federal bankruptcy court.
To ensure compliance with federal bankruptcy laws, before an agency can set up a bankruptcy record:
- The agency must verify the bankruptcy case to ensure it is active and has not been discharged.
- The state debtor or payee must have at least one hold record on file.
The debtor or payee can submit notification of an active bankruptcy case:
- To the hold source agency via U.S. mail or other method approved by the agency.
- When the debtor is a payee who has a warrant on hold and receives the Notice of State Payments Held, form Section B – Bankruptcy Status on the back may be submitted to the Comptroller’s office.
BKRUPD includes only one screen, which is used to:
- Recall a bankruptcy record.
- Add a bankruptcy record.
- Change a bankruptcy record.
- Delete a bankruptcy record.
Accessing BKRUPD
There are two methods of accessing BKRUPD.
Method 1. From the TINS – Update Menu (PYMENU) screen:
- Enter PYMENU on Line 1 on any TINS screen and select Enter.
- Enter N (BKRUPD) in the
ENTER OPTIONfield. - Select Enter to display the screen.
Method 2. Enter BKRUPD on Line 1 on any TINS screen and select Enter to display the screen.
