Health Fitness Activities, Education and Programs
A state agency may use available public funds and facilities for health fitness education and activities. To promote better health and fitness among its employees, a state agency may:
- Allow an employee 30 minutes during normal working hours for exercise three times a week. Employees are still required to work a 40-hour week. An employee who uses work hours to exercise must either make up the time or use paid time off, such as annual leave.
- Allow all employees to attend on-site wellness seminars when offered.
- Provide eight hours of additional leave time each year to an employee who:
- receives a physical examination, and
- completes a health risk assessment.
- Provide financial incentives for participation in a wellness program designed to increase work productivity and capacity and reduce health insurance costs, or a wellness program based on the model program or components of the model program developed by the Department of State Health Services.
- Offer certain on-site clinic or pharmacy services.
- Adopt additional wellness policies, as determined by the agency.
A state agency may enter into an agreement with another state agency, a state-supported college or university, or a local or federal governmental agency to jointly present or participate in health fitness education or activity programs.

A state agency must retain documentation in its files that cites the statutory authority for the agency’s health fitness program and provides a clear and complete description of the services provided under the program.
