Professional Sports

A state angency may not enter into an agreement with a professional sports team that requires a financial commitment by this state entity unless the agreement includes:

  1. A written verification that the professional sports team will play the U.S. national anthem at the beginning of each team sporting event held at the team’s home venue or other facility used by the team for the event.
  2. A provision providing that failure to comply with the written verification for any sporting event at the team’s home venue or other facility:
    • Constitutes a default of the agreement.
    • Immediately subjects the team to any penalty the agreement authorizes for default.
    • May subject the team to debarment from contracting with this state.

Definitions:

Professional sports team
A team organized in this state that is a member of Major League Baseball, the National Basketball Association, the National Hockey League, the National Football League, Major League Soccer, the American Hockey League, the East Coast Hockey League, the American Association of Independent Professional Baseball, the Atlantic League of Professional Baseball, Minor League Baseball, the National Basketball Association Development League, the National Women’s Soccer League, the Major Arena Soccer League, the United Soccer League or the Women’s National Basketball Association.
Sporting event
Any preseason, regular season or postseason game of a professional sports team.
