Cancellation Fees and Similar Charges
A state agency or the Statewide Procurement Division (SPD) of the Comptroller’s office may pay a cancellation fee, restocking charge or other similar charge if the agency or commission determines the charge is justifiable.
Definitions:
- State agency

- A department, commission, board, office or other agency in the executive branch of state government created by the state constitution or a state statute.
- The Supreme Court, the Court of Criminal Appeals, a court of appeals or the Texas Judicial Council.
- A university system or an institution of higher education as defined by Texas Education Code Section 61.003, except a public junior college.

Documentation Requirements [+]
The following documentation requirements apply only to a purchase voucher submitted by a state agency to pay a cancellation fee or a similar charge:
- Upon request, a copy of the determination stating the fee or charge is justifiable must be available to the Comptroller's office during a pre-payment or post-payment audit.
- Comptroller object 7210 must be used.
