Contract Expenditures
County Clerks

A state agency may pay a fee to a county clerk for the following services:

  • Personal property records filings
  • Real property records filings
  • Certified papers
  • Noncertified papers
  • Birth or death certificates
  • Bond approvals
  • Brand registrations
  • Oath administrations
  • Returned checks
  • Records management and preservation fees
  • Records archive fee
  • Other duties prescribed or authorized by statute for which a fee is not prescribed by Subchapter B of Chapter 118, Local Government Code, if the fee charged by the county clerk is reasonable

Generally, the Local Government Code prohibits the state from making a payment to a county officer who is paid an annual salary. However, it does not prohibit the payment of the above fees.
