International Cooperation Agreements
A state agency may enter into an agreement with the United Mexican States, a political subdivision of the United Mexican States, an agency of the United States, or an agency or entity created under a treaty or executive agreement between the United States and the United Mexican States, if the agreement helps accomplish a function within the agency’s statutory duties and responsibilities.
A state agency may:
- Acquire or dispose of an interest in real property in this state or the United Mexican States.
- Use any funds of the agency not otherwise dedicated by law for another purpose to accomplish the purposes of the agreement.
- Use any equipment, facilities or other property of the agency to carry out the agreement.
- Agree to any other terms not prohibited under state or federal law.
An agreement made by a state agency under this chapter involving the use of money appropriated from the State Treasury must be approved by both the governor and the Legislative Budget Board.
International Cooperation Agreements
Definitions:
- Political subdivision
- Includes any corporate and political entity organized under state law.
- State agency
- Except as otherwise stated in this section, is defined as a state board, commission, department or office having statewide jurisdiction. The term does not include a state college or university.

Texas Department of Transportation
The Texas Department of Transportation (TxDOT) may enter into a contract or operating agreement with a similar authority or agency of a state of the United Mexican States if both the governor and the Texas Transportation Commission approve the contract or agreement.
TxDOT and a private entity jointly may enter into an agreement with the United Mexican States or a state of the United Mexican States to:
- Independently or jointly provide services,
- Study the feasibility of a turnpike project, or
- Finance, construct, operate and maintain a turnpike project.
TxDOT may not enter into the agreement without the approval of both the Texas Transportation Commission and the governor.
