Contract Expenditures
County Clerks
A state agency may pay a fee to a county clerk for the following services:
- Personal property records filings
- Real property records filings
- Certified papers
- Noncertified papers
- Birth or death certificates
- Bond approvals
- Brand registrations
- Oath administrations
- Returned checks
- Records management and preservation fees
- Records archive fee
- Other duties prescribed or authorized by statute for which a fee is not prescribed by Subchapter B of Chapter 118, Local Government Code, if the fee charged by the county clerk is reasonable
Generally, the Local Government Code prohibits the state from making a payment to a county officer who is paid an annual salary. However, it does not prohibit the payment of the above fees.
