State Agency Responsibilities
Reporting State Debts
All state agencies are required to report their debtors to the Comptroller’s office. Examples of a state debt include a tax delinquency, delinquent payment of state fees, or defaulted student loans. Reporting state debts enables the Comptroller’s office to hold payments in accordance with Texas Government Code, Section 403.055
.
Each agency must comply with Texas Government Code, Section 403.055, subsections (g) and (g-1). The agency may not report its debtors to the Comptroller’s office until it has given its debtors a chance to exercise their due process. In addition, when the agency reports the debtor to TINS, it must notify the debtor that it is being reported to the Comptroller’s office.
Hold Source Agency Designation
Before a state agency can report its debtors to the Comptroller’s office, it must:
- Be designated a hold source agency by the Comptroller’s office by submitting the Application to Report Indebtedness form (74-188)
. - Provide the type of debt to be reported with a legal reason or statutory citation for each type.
- Be assigned a hold reason code for each type of debt it will report.
