Grants

State agencies may impose limitations and requirements on how a recipient spends grant money without converting the grant into a service contract or other agreement.

The test for determining if an expenditure is a grant is if the state directly receives any consideration or benefits from the person or entity receiving the money. Appropriation year determination procedures apply to grants paid with appropriated funds.

A state agency must distribute appropriated grant money on a reimbursement or an as-needed basis unless:

  • Otherwise provided by statute.
    – or –
  • The agency determines another distribution method is necessary for the purposes of the grant.

Grant Restrictions

A state agency may not award a grant to an entity for the provision of mental health services to veterans or veterans’ families unless the entity demonstrates it:

  • Has previously received and successfully executed a grant from the state agency.
    – or –
  • Provides training on military informed care or military cultural competency to entity personnel who provide mental health services to veterans or veterans’ families or requires those personnel to complete military competency training provided by any of the entities defined in Texas Government Code Section 434.352(e)(2).

The Texas Veterans Commission and the Department of State Health Services shall jointly verify that each state agency authorized to award a grant subject to the requirements above has adopted policies to ensure compliance with Sec. 434.352(e).

Definition:

Grant
An expenditure of funds from the State Treasury to a person or entity that does not directly provide consideration or a benefit to the state in exchange for the funds. This includes a grant-in-aid.
