Payment of Compensatory Time Earned During a Declared Disaster or Emergency

Background

At the discretion of the agency head, an employee may be paid at the employee’s regular hourly salary rate for the hours of compensatory time the employee earned for work directly related to a disaster or emergency declared by the appropriate office of the state or federal government.

Employees must either:

  • Be paid for this time.
    – or –
  • Take the compensatory time off in the 12-month period following the workweek the compensatory time was earned in.

If the employee receives payment for the compensatory hours, the compensatory time balance must be reduced by one hour for each hour the employee is paid for.

Notification

The agency must notify the Comptroller’s office of its intent to pay compensatory time to eligible employees. The notification must include:

  • Documentation identifying the declared disaster or emergency for which the time was earned.
    – and –
  • A list of the employees who will be paid in association with the request.
